Request to extend an emergency protection measure

When urgent intervention by the Director of Youth Protection (DYP) is necessary to ensure a child’s safety, a request to extend the emergency protection measure may be submitted to the court. This emergency procedure seeks to temporarily prolong the existing protective measures for a maximum of five working days. This period is critical to allow the DYP to continue its investigation and assess the child’s situation before long-term decisions are made.

An urgent procedure with lasting consequences

The request to extend the emergency protection measure is presented urgently before the Court of Québec in the days following the initial DYP intervention. During this time, the child may be temporarily removed from the family or subject to contact or freedom restrictions.

Although this step is fast, its consequences can be significant. The decisions made at this point can influence the entire case: custody, findings of endangerment, provisional measures… This is why it is crucial to act immediately once you are informed of such a hearing.
